PayPal Settles with DOJ for $30 Million Over 2020 Black-Owned Business Program

PayPal has reached a settlement with the Department of Justice (DOJ) involving a waiver of $30 million in processing fees related to small business transactions. This settlement was finalized on May 12 and addresses concerns stemming from a 2020 initiative designed to support Black and minority-owned businesses.
Settlement Details
The DOJ’s investigation into PayPal focused on a $530 million program that aimed to promote diversity in business financing. The government asserted that this initiative violated the Equal Credit Opportunity Act, which prohibits credit discrimination based on race or ethnicity.
New Initiatives for Businesses
- PayPal will initiate a program specifically for veteran-owned small businesses.
- This program will also target businesses in the farming, manufacturing, and technology sectors.
Despite the settlement, PayPal has not admitted to any wrongdoing and will not incur additional fines. Acting Attorney General Todd Blanche emphasized the DOJ’s commitment to eliminating perceived unlawful diversity, equity, and inclusion initiatives from corporate America.

While this settlement is significant, it follows IBM’s recent agreement to pay $17 million to the DOJ over similar DEI-related issues, where they also did not acknowledge any wrongdoing. Legal experts suggest that both settlements exemplify a broader scrutiny of past corporate practices regarding diversity initiatives since 2020.
David Glasgow, co-founder of the Meltzer Center for Diversity, Inclusion, and Belonging at New York University School of Law, noted that the current administration’s stance reflects a willingness to examine historical compliance concerning DEI initiatives.
