Donald Trump’s legal team has filed an appeal in New York, seeking to overturn his criminal conviction related to hush-money payments. This request was submitted on Monday night to an intermediate appeals court in Manhattan.
Details of the Appeal
The appeal centers on the argument that Trump is entitled to presidential immunity. His attorneys from the prominent law firm Sullivan & Cromwell argue that the case should never have been prosecuted. Robert Giuffra, co-chair of the firm, intends to present oral arguments personally during the hearing.
In May 2024, a jury convicted Trump on 34 counts of falsifying business records to conceal payments made to adult film actress Stormy Daniels prior to the 2016 election. The case was initiated by the Manhattan district attorney’s office, overseen by Justice Juan Merchan of the New York Supreme Court.
Legal Proceedings and Supreme Court Involvement
During the trial, discussions arose regarding presidential immunity, particularly relating to a separate case stemming from the January 6 Capitol riot. A ruling by the US Supreme Court in July granted broad immunity protections to former presidents. This decision has become a pivotal point in Trump’s appeal.

They claimed the trial judge misinstructed the jury on weighing charges and that potential conflicts of interest should have prompted the judge’s recusal.
The legal team expressed confidence that the Supreme Court’s ruling on immunity would necessitate an automatic reversal of the conviction. A spokesperson emphasized that Trump’s commitment to countering what they describe as politically motivated attacks remains strong.
Next Steps in the Legal Process
The recent appeal is directed to the Appellate Division—First Department. If the decision goes against Trump, the case could move to the New York Court of Appeals, followed potentially by the US Supreme Court.
In addition, Trump’s attorneys have pursued options for a federal review of future appeals, which may expedite the process. The Sullivan & Cromwell firm is also handling Trump’s appeal regarding a $500 million civil fraud ruling involving New York Attorney General Letitia James, which was partially upheld by an appeals court in August.
