Judge Illston ruled in favor of requests from two unions representing federal employees. She stated that the layoffs were conducted unlawfully amid a funding lapse that began on October 1. Illston pointed to various public statements from President Donald Trump and budget chief Russell Vought, which she interpreted as politically motivated.

Impending Layoffs by Federal Agencies

  • Treasury Department: Notices sent to around 1,446 employees.
  • Department of Health and Human Services: Initially announced layoffs for 1,100 to 1,200 employees, later adjusting this number downward.
  • Department of Education: Planning to lay off at least 400 workers.
  • Department of Housing and Urban Development: Also aiming for a reduction of around 400 employees.
  • Other Departments (Commerce, Energy, Homeland Security): Cuts ranging from 176 to 315 employees.

In total, Vought suggested that layoffs during the shutdown could exceed 10,000 federal positions. He described the announced reductions as only a preliminary estimate.

Reactions from Unions and Political Context

The American Federation of Government Employees and the AFL-CIO filed the initial lawsuit, claiming that layoffs do not qualify as essential services during funding lapses. They argued that most federal employees are currently furloughed without pay, which further questions the justification for mass firings.

As the shutdown entered its third week, the Senate failed once again to adopt a resolution to reopen the government. This marked the ninth unsuccessful attempt.
