USDE: Kansas School Districts’ Gender Identity Policies Violate Federal Law

The United States Department of Education is directing four Kansas school districts to change their policies regarding students’ gender identities. This decision impacts Topeka Public Schools, Kansas City, Kansas Public School District, Shawnee Mission School District, and Olathe Public Schools.

Review of Policies by Federal Officials

The Office for Civil Rights (OCR) scrutinized these districts’ policies after a request from Attorney General Kris Kobach and a complaint from the conservative education organization, DFI. OCR found several practices that allegedly contravene Title IX protections and the Family Educational Rights and Privacy Act (FERPA).

  • Allowing male students to access female restrooms, locker rooms, and changing areas based on their declared gender identity.
  • Permitting male students to participate in single-sex athletics in a manner consistent with their gender identity.

Kimberly Richey, Assistant Secretary for Civil Rights, emphasized that these policies not only violate federal law but also compromise parental trust. She stated, “Schools should never subject girls to unsafe, uncomfortable, and unfair environments.”

School District Responses

In response, the USD 501 officials claimed their practices comply with federal laws and pointed to a recent state law aimed at alleviating OCR’s concerns. They expressed their commitment to working with OCR for clarity and improvement. They asserted, “The safety, security, and dignity of every Topeka Public Schools student is our top priority.”
