Defense Attempts to Intoxicate Defendant in Courtroom Drama

In June 2024, Tomasz K., the mayor of Chocianów, was involved in a serious incident in Lubin. He crashed his Porsche into another vehicle and fled the scene, according to reports from El-Balad. The victim called the police, who located Tomasz K. at his home within approximately 20 minutes. Upon arrival, officers found him highly intoxicated.
When approached for arrest, Tomasz K. resisted and threatened the police officers, claiming his official position to intimidate them. A breathalyzer test conducted a few hours later revealed a blood alcohol concentration of 2.6 promille, highlighting the severity of the situation.
Courtroom Drama: Defense Attempts to Intoxicate Defendant
Recent court proceedings in Lubin showcased an unusual defense strategy. During a hearing at the District Court, Tomasz K.’s lawyer proposed conducting a court experiment involving the consumption of 600 ml of vodka. The objective was to determine how quickly the accused could drink that amount of alcohol.
Prosecutor Responds to Defense Request
Presiding Judge Agnieszka Bem-Iwańska requested input from the prosecutor regarding this unconventional defense request. Prosecutor Kacper Zakrzewski firmly opposed the idea, labeling it as inadmissible due to the direct risks it posed to the health and safety of the defendant.
- The court ultimately dismissed the defense’s motion.
- It was noted that public funds would have been necessary to purchase the vodka for the experiment.
- The court has decided to hear expert witnesses to assess the defendant’s mental state and legal capacity.
Tomasz K.’s legal troubles continued after the crash, which resulted in ongoing legal proceedings. In March 2025, the court issued a ruling, imposing a fine of 10,000 PLN, a three-year driving ban, and vehicle confiscation. However, the prosecutor described this sentence as exceedingly lenient and filed an appeal.
The case against Tomasz K. remains active, with potential consequences including up to five years in prison. Notably, the mayor has frequently failed to attend his court hearings, and a verdict is expected soon.
