White House Establishes National Framework for Artificial Intelligence Policy

The White House has announced a significant initiative to establish a national framework for Artificial Intelligence (AI) policy. This effort is aimed at bolstering the United States’ leadership in AI technology, which plays a critical role in national security and economic growth.
Purpose of the National AI Framework
The primary goal of this initiative is to streamline regulations surrounding AI, allowing for greater innovation and competitiveness. The previous Executive Order 14179, issued on January 23, 2025, focused on removing barriers to U.S. leadership in AI. The new framework seeks to ensure that American AI companies can thrive without excessive state regulations that create inconsistencies across the country.
Challenges of State Regulations
Currently, the diverse regulatory environment created by state laws presents several challenges:
- Patching Together Regulations: Different states have varying regulations, making compliance complex, particularly for startups.
- Ideological Bias: Some state laws, like Colorado’s ban on algorithmic discrimination, may enforce ideological standards that affect AI model accuracy.
- Interstate Commerce Issues: Certain state laws extend their reach beyond state lines, complicating interstate commerce.
Policy Implementation Steps
The new policy is designed to foster U.S. AI dominance with a minimally burdensome national standard. Key steps include:
- Formation of an AI Litigation Task Force: This task force will challenge state laws that conflict with the national framework. It will be established within 30 days of the order.
- Evaluation of State AI Laws: The Secretary of Commerce will review existing state laws within 90 days to identify those that are overly restrictive or conflicting with federal policy.
- Funding Restrictions for States: States that implement cumbersome AI regulations may become ineligible for certain federal funding.
Safeguards and Reporting Standards
The White House’s initiative also emphasizes the importance of safeguarding communities and ensuring ethical AI use:
- First Amendment Protections: The evaluation process will focus on laws affecting the free speech rights of AI developers.
- Federal Reporting Standards: Within 90 days, a new reporting standard will be considered to preempt conflicting state laws.
Legislative Recommendations
A legislative recommendation will be prepared to establish a uniform federal AI policy that preempts conflicting state regulations. However, the recommendation will still respect laws that protect child safety and outline the use of AI in state procurement.
