New Proposed Settlement Timeline
Currently, most migrants on work and family visas can apply for settled status after five years of residency. However, the proposed reforms will change this baseline:
- Standard waiting period will increase from five to ten years.
- Migrants who came on post-Brexit health and social care visas may face a 15-year wait.
- Additional penalties will be imposed on those who have claimed public benefits.
Earned Settlement System
The government intends to introduce an “earned settlement” system. This new approach requires migrants to:
- Demonstrate social integration.
- Show economic contribution.
- Maintain good character.
Settlement in the UK, referred to as Indefinite Leave to Remain (ILR), enables individuals to reside permanently, work without restrictions, and access public services. Additionally, it is an essential step towards obtaining British citizenship.
