TUI Compensates Holidaymaker Hospitalized with Legionnaires’ Disease

Gary Cushnie recently reached a settlement with TUI, a package holiday provider, after he contracted Legionnaires’ disease following a vacation in Cuba. Despite a five-figure compensation agreement, TUI has not admitted liability.

Mr. Cushnie, 63, began feeling unwell during his trip in June 2022, experiencing severe chest pains and shortness of breath just six days in. These symptoms left him fatigued and unable to fully enjoy the holiday with his partner, Julie.
Hospitalization and Diagnosis
After returning to East Yorkshire, Mr. Cushnie required emergency medical attention. An ambulance took him to Hull Royal Infirmary, where he spent over a week receiving treatment for pneumonia and pleurisy. Blood tests later confirmed the diagnosis of Legionnaires’ disease, which necessitated intravenous antibiotics.

Hudgell Solicitors represented Mr. Cushnie in his claim against TUI. They argued that inadequate hygiene standards at the Havana hotel contributed to the outbreak of Legionnaires’ disease. Lack of maintenance records and hygiene inspection reports were cited as causes for concern.

Following his experience, Mr. Cushnie has urged travelers to take extra precautions when staying in hotels. He recommends turning on all taps upon arrival to flush the water system.
TUI’s Response
A spokesperson for TUI expressed sympathy for Mr. Cushnie’s situation and stated that the settlement was reached due to insufficient evidence concerning their operations in Cuba. The company no longer operates in the region.
