Deere Resolves Right-to-Repair Lawsuit, Allocates $99M Fund for Farmers

Deere & Company, the prominent U.S. agricultural equipment manufacturer, has settled a significant lawsuit concerning repair access for farmers. The company announced on Monday its commitment to create a $99 million settlement fund aimed at benefiting farms involved in a class action lawsuit related to repair costs and accessibility.

Settlement Details and Right-to-Repair Movement

This case falls under the broader scrutiny of right-to-repair practices in the U.S. Critics argue that manufacturers often restrict competition by controlling access to repair tools and software.

Key Terms of the Settlement

  • Deere will allocate $99 million to a settlement fund for eligible farmers.
  • The fund will cover repairs conducted by authorized dealers since January 2018.
  • Farmers will gain access to digital tools essential for the maintenance and repair of various machinery, including tractors and combines, for a decade.

The proposed settlement is pending judicial approval. Deere’s statement indicated that this agreement resolves the concerns raised in a 2022 complaint without admitting any wrongdoing.

Ongoing Legal Challenges

In addition to this settlement, Deere faces another legal challenge from the U.S. Federal Trade Commission (FTC). A federal judge ruled that the FTC can proceed with its lawsuit, which alleges that Deere compels farmers to use its authorized dealer network, ultimately increasing their repair costs.

According to the FTC, Deere obstructs farmers from obtaining “tools and information necessary to repair their equipment in a timely and cost-effective manner.” Despite these accusations, Deere maintains its stance of not engaging in any wrongdoing.

As the right-to-repair movement gains traction, manufacturers like Deere are under increasing pressure to provide farmers greater control over repairs, emphasizing the need for transparency and accessibility in agricultural equipment maintenance.
