Karl Malenfant Demands Gallant Report Cancellation Amid SAAQclic Fiasco

Karl Malenfant, the architect of the SAAQclic project, is taking legal action to demand the cancellation of the Gallant report. His complaint highlights significant errors that he believes have compromised the integrity of the commission’s findings. Filed on March 19 in Montreal, the 42-page lawsuit asserts that Malenfant was unfairly denied participant status, limiting his opportunity to effectively present his case.

Legal Challenge to the Gallant Report

In his lawsuit, Malenfant claims he was deprived of adequate time to review an extensive 9809-page document, which he received only seven days before his scheduled testimony last autumn. His attorney, Jean-François Bertrand, points out that under these circumstances, it was unrealistic for Malenfant to properly prepare.

Concerns Over the Commission’s Process

  • Malenfant was only allowed to submit a sworn statement after five days of testimony.
  • In December, he submitted a second sworn statement following 45 “notices of potential reprimand” from the commission.
  • Despite assurances from his lead attorney, Simon Tremblay, this additional statement was allegedly ignored by the commission.

This situation left Malenfant stunned upon reviewing the complete report, which spans 826 pages including annexes. He criticizes several conclusions drawn by Commissioner Denis Gallant as “unreasonable.” His lawsuit identifies ten specific conclusions that he argues undermine the report’s overall logic.

Impact of SAAQclic’s Launch

The SAAQclic platform, launched province-wide in winter 2023, faced significant backlash from users, resulting in long queues at service points. Malenfant denies any wrongdoing in favoring a “Big Bang” approach for the launch. He seeks not only the annulment of the Gallant report but also asks that the ten unfavorable conclusions against him be deemed non-applicable.

Serious Allegations Against SAAQ

The Gallant report, presented in mid-February, accused the SAAQ of deceptive practices related to its digital transition for nearly a decade. Malenfant has been singled out for numerous allegations, including steering contracts towards acquaintances.
