Explanation of Agreement with Police

As an educational institution, it is vital to provide a safe environment for students and visitors while promoting open dialogue and demonstration. Safety measures are particularly critical due to specific facilities on campus, including research reactors and numerous laboratories. TU Delft acknowledges the need for collaboration with law enforcement to ensure security.
Collaboration with Police: Agreement Overview
In pursuit of enhanced safety protocols, TU Delft has entered into a formal agreement with local police. This covenant outlines procedures for information exchange under specific circumstances, such as:
- Missing persons
- Protection of vulnerable individuals
- Physical security concerns
- Management of demonstrations
Recent Data Sharing Incident
In 2024, TU Delft shared personal data of several demonstrators at the request of police. Authorities deemed the demonstration potentially dangerous to public safety and property. This data sharing was in line with established guidelines; however, it raised concerns regarding compliance with privacy laws (GDPR).
Review of Current Procedures
Recent evaluations revealed shortcomings in the execution of the agreement regarding data sharing and registration processes. Consequently, TU Delft plans to investigate how to enhance the implementation of the covenant.
New Protocols for Data Sharing
Moving forward, TU Delft will only share personal data with police upon explicit approval from the Executive Board. Key elements of the new protocol include:
- Centralized documentation of all data sharing
- Annual audits of data disclosures
Importantly, sharing personal data in relation to demonstrations will not be standard practice. This practice has occurred only once in the past two years, highlighting its exceptional nature.
Adapting Demonstration Policies
In response to these developments, TU Delft has previously revised its own policies on demonstrations. The goal is to clarify the balance between the right to protest and the necessity of maintaining safety. This ongoing dialogue will involve consultations with relevant stakeholders to refine the agreement’s structure and functionality.
Commitment to Safety and Privacy
TU Delft’s primary commitment remains to ensure the safety of staff, students, and visitors. This must be achieved while respecting privacy rights and the freedoms associated with protest and debate.
