Tennessee to Issue IDs, Driver Licenses for Documented Immigrants from New Year’s Day

Tennessee is set to implement significant changes regarding identification for lawful permanent residents starting January 1. A new law will distinguish between the IDs issued to U.S. citizens and those for non-citizens.

Tennessee’s New Identification Law for Immigrants

The upcoming legislation requires lawful permanent residents to provide proof of U.S. citizenship when renewing or reinstating their driver’s licenses or ID cards. Failing to provide this proof will result in the issuance of a temporary ID, specifically designed for non-citizens.

Key Provisions of the Law

  • Proof of Citizenship: Lawful permanent residents must show evidence of citizenship for ID renewals after January 1.
  • Temporary IDs: If proof is not provided, recipients will receive a temporary form of identification.
  • Visual Distinction: Temporary IDs will have unique markers differentiating them from those issued to U.S. citizens.

Voting Restrictions

The law specifies that temporary IDs will not be valid for activities exclusive to U.S. citizens, such as voting. Although voting restrictions for non-citizens have been emphasized, they are already prohibited from participating in federal, state, and most local elections.

Research shows there is minimal evidence of non-citizen voting. The Migration Policy Institute points out that audits indicate voter fraud involving non-citizens is exceedingly rare.

Penalties for Voting

Non-citizens who illegally attempt to register or vote can face severe repercussions, such as:

  • Up to five years in prison
  • Potential deportation

This new legislation reflects Tennessee’s commitment to enforcing identification requirements while also highlighting the minor role non-citizens play in the electoral process. As these laws take effect, it will be important for residents to stay informed about their eligibility and the necessary documentation.
