The New Orleans City Council has taken proactive steps to protect its residents amid growing concerns regarding federal immigration enforcement. On November 21, Vice President Helena Moreno, alongside Council President JP Morrell, unveiled a comprehensive rights guide aimed at informing residents about their legal protections during potential encounters with federal agents.
New Orleans’ Rights Guide Amid ICE Operations
This initiative coincides with President Trump’s upcoming Operation Swamp Sweep (Operation SS), which involves the deployment of heavily armed Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) units in urban areas. These operations have faced widespread criticism for alleged rights violations, particularly in communities with significant Black and brown populations.
Key Provisions of the Rights Guide
The two-page guidance document provides crucial information for New Orleanians regarding their rights when interacting with ICE and CBP officers. The advice is informed by the National Immigration Resource Center and serves as a resource for both documented and undocumented individuals.
- Legal Status: Residents with legal documentation should carry proof such as a passport, permanent resident card, or work permit.
- Right to Remain Silent: Undocumented individuals have the right to remain silent and are not required to disclose their immigration status.
- Warrant Requirements: Federal agents must possess a warrant signed by a judge to enter private residences. ICE forms do not qualify.

In her statement, Moreno emphasized the city’s commitment to ensuring the safety and rights of its residents. She urged the local legal community to assist in protecting individual rights and providing necessary legal aid. The guide also includes links to local legal resources, such as:
